How do I request service of court papers?

Start with the official Civil Process Service page provided by the San Diego County Sheriff’s Office and confirm that the Civil Division accepts the type of papers you need served. Prepare the required service instructions, court documents, copies and applicable payment or fee-waiver documentation, then submit them through the appropriate Civil Division office. Not every type of court paper is routinely served by the Civil Division.

Check whether the Civil Division accepts your request

The Sheriff’s Office lists restraining orders and enforcement processes, including certain writs and levies, among its continuing services. It generally does not serve routine non-enforcement papers, such as summons and complaints or hearing notices, except in specified circumstances.

The published instructions include an exception for qualifying court orders waiving the Sheriff’s service fees. Review the accepted-service list and confirm your document type with a civil office before submitting papers or payment.

Prepare the required instructions and documents

The Sheriff’s Office requires Form SER-001, Request for Sheriff to Serve Court Papers, for service requests. Its instructions also identify Form SER-001A for writ-related services and separate requirements for wage garnishments. Obtain current forms through the official service page and follow the instructions for your specific process.

Before submitting, check that your packet includes:

  • Completed service instructions signed by the attorney of record or the party without an attorney.
  • The court papers and any required attachments.
  • The required number of copies for each person or entity to be served.
  • The service address and identifying information requested by the forms.
  • Any hearing dates, service deadlines and relevant safety information.
  • Applicable fees or the required fee-waiver documentation.

Copy requirements vary by document type. Follow the published Civil Process Service instructions to determine how many copies your request requires.

Confirm the office, fees and submission method

Use the official Civil Office Locations directory to contact the appropriate office. Confirm where to submit your packet, accepted delivery methods and payment requirements. Civil process service is separate from routine patrol coverage.

If relying on a court-issued waiver of the Sheriff’s fees, the Sheriff’s Office requires a certified copy of the applicable order. Confirm that the order covers the requested service.

The service page limits its email submission system to litigants with qualifying court-issued fee waivers. Follow those eligibility instructions; the submission system is not a channel for general questions. Direct questions to a civil office.

Check service status and proof of service

Keep your submission confirmation and any civil file number provided. Ask the receiving office how to check status and obtain proof of service or notice of an unsuccessful attempt. Submitting a packet does not confirm that service has been completed.

If you need help determining the legally required service method or responding to unsuccessful service before a deadline, contact the court’s self-help center or an attorney. The Civil Division cannot provide legal advice.
